Terms of Service
These Terms of Service ("Terms") govern your use of MoosePad, a product of Moosen AI, Inc. ("Moosen AI," "we," "us," or "our"). By downloading, installing, or using MoosePad, you agree to be bound by these Terms. If you do not agree, do not use the app.
1. Overview
MoosePad is a meeting note-taking application for iPhone, iPad, and Mac that records audio, transcribes speech using on-device Apple Speech Framework, and generates AI-powered summaries.
2. Eligibility
You must be at least 13 years old to use MoosePad. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the app, you represent and warrant that you meet these requirements.
3. Your Account
MoosePad uses Sign in with Apple for authentication. You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
4. Subscriptions and Payments
Subscription plans
MoosePad offers subscription plans and a lifetime license option. Details about pricing, features, and plan limitations are available on our Pricing page and within the app.
Free trial
New users may be eligible for a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the listed price.
Billing
All payments are processed by Apple through the App Store. By subscribing, you agree to Apple's payment terms. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
Cancellation and refunds
You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Refund requests must be directed to Apple, as we do not process payments directly. For the lifetime license, no refunds are available after purchase except as required by applicable law.
Family Sharing
MoosePad supports Apple Family Sharing. When Family Sharing is enabled, up to five additional family members may access MoosePad under a single subscription. Each family member's data remains private to their own device and iCloud account.
5. Acceptable Use
You agree to use MoosePad only for lawful purposes and in accordance with these Terms. You agree not to:
- Record conversations without the consent of all participants where required by law
- Use MoosePad in violation of any applicable local, state, national, or international law or regulation
- Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the app
- Modify, adapt, or create derivative works based on MoosePad
- Remove, alter, or obscure any proprietary notices or labels on the app
- Use MoosePad for any illegal surveillance or monitoring activities
Recording consent
Important: Many jurisdictions require the consent of all parties (or at least one party) before recording a conversation. It is your sole responsibility to understand and comply with all applicable recording consent laws in your jurisdiction. Moosen AI is not responsible for any legal consequences arising from your use of the recording features.
6. Intellectual Property
MoosePad and all related trademarks, logos, and content are the property of Moosen AI, Inc. These Terms do not grant you any right, title, or interest in MoosePad except for a limited, non-exclusive, non-transferable, revocable license to use the app in accordance with these Terms.
Your content
You retain all rights to the recordings, transcripts, summaries, and notes you create using MoosePad. Your content is stored on your device (and optionally in your iCloud account), and we do not claim any ownership or license to your content.
7. Privacy
Your privacy is fundamental to MoosePad. Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Disclaimers
MoosePad is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The app will be uninterrupted, error-free, or free of viruses or other harmful components
- Transcriptions or AI-generated summaries will be completely accurate
- The app will be compatible with all devices or operating system versions
- Results obtained from the app will meet your requirements
MoosePad relies on Apple Intelligence and Apple Speech Framework for its core functionality. Changes to these Apple technologies may affect MoosePad's features and performance. We are not responsible for any changes Apple makes to their frameworks or services.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Moosen AI, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of MoosePad, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
In no event shall our total liability to you for all claims arising out of or related to these Terms or MoosePad exceed the amount you have paid to us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Moosen AI, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of MoosePad, your violation of these Terms, or your violation of any rights of another party, including but not limited to recording consent laws.
11. Termination
We may suspend or terminate your access to MoosePad at any time, with or without cause, and with or without notice. Upon termination, your right to use MoosePad will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
You may terminate your use of MoosePad at any time by deleting the app from your devices and canceling any active subscription through your Apple ID settings.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the app. Your continued use of MoosePad after any changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of MoosePad shall be resolved in the state or federal courts located in King County, Washington.
14. General
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Moosen AI regarding MoosePad.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
